iPod fathers unveil their next project, the Nest Learning Thermostat (hands-on)

Over the summer, we got word that a couple of unnamed ex-Apple engineers were getting ready to unveil an unnamed product, under the guise of an unnamed startup. As it turns out, that startup was Nest Labs, and those Apple alums were none other than Tony Fadell, longtime SVP of Apple’s iPod division, and lead engineer Matt Rogers. And yes, the product they had to share makes fine use of a click wheel.

But if you thought they’d be cooking up a next-gen music player, you’d be wrong. Instead, the pair have been designing a thermostat, of all things, dubbed the Nest. In addition to being the most stylish model ever to grace a dining room wall, it promises the kind of intelligence we’ve come to expect in other household appliances — just not thermostats, per se. It’ll go on sale next month for $249 in places like Best Buy, but we managed to snag an early sneak peek. Netflix US subscriber count drops by 800k in Q3, 21.45 million still streaming

After a tumultuous third quarter the numbers are finally in for Netflix, and as expected its price hike and Qwikster madness have cost it a few customers in the US. Currently the company is reporting a total of 23.79 million customers in the US, down from 24.59 million last quarter — fewer than even it projected a few weeks ago. According to the report, it lost more “long term” customers than expected, which it attributes, again, to its poor explanation of the reasoning behind the change. To address those decisions and its inability to reach a new deal with Starz it has a few more numbers to show, as apparently only 7 percent of new customers are opting for the $15.98 hybrid package, while Starz Play content currently accounts for about six percent of streaming hours. Other competitors are also mentioned — Amazon Prime Instant Video’s content library is referred to as “duplicative” and just a “small fraction” of what Netflix offers, as it counts on newly-signed exclusive deals to widen the gap.

Those deals mean new movies like Drive, Paranormal Activity 3, The Rum Diaries and The Immortals will show up on Netflix in the usual pay-TV window, on top of a library of catalog TV shows that pulls from all five broadcast networks and 95 percent of cable TV stations. Internationally, Netflix is up to one million customers in Canada where it plans to double quarterly content spending, while Latin American customers can look forward to iOS and Xbox support soon. While its UK launch is on for Q1, it expressed concern for competition from Sky Movies, BBC and Lovefilm, and it plans to hold off on further expansion after that. Garmin releases first fitness app — Garmin Fit

Garmin has long been a name synonymous with GPS systems, and now they have released their first fitness application for Android and iOS.  Says Dan Bartel, Garmin's VP of worldwide sales:

Search Site Loku Leverages Big Data To Make Local Search Simpler

Instead of making the user pour through crowdsourced information, Loku uses natural language search to serve up the most relevant articles in a given area through its “Know Local” function, allowing people to look for relevant media around the topics of “Good Eats,”"Culture,” etc. It’s “Go Local” function lets people use a slider to sift through a sentiment rank of the places around them.

Toyota pulls Cydia theme and ads to appease Apple

Apple asks Toyota to remove jailbreak Cydia theme

In news that will no doubt shake the very bedrock of your belief system, Apple has asked Toyota to remove its Scion theme and its advertising from ModMyi, a Cydia repository. The Scion theme has been available for weeks, but after it received a ton of press in the last couple of days, Apple finally lashed out.

It’s not like we should be surprised, considering Apple has claimed in the past that jailbreaking is illegal – but at the same time, did the Cupertino cronies hear about the ruling that made circumventing DRM, and thus jailbreaking, legal? Anyway, whether Toyota was supporting illegal, legal, or deliciously gray and ambiguous, activity, it doesn’t matter: Apple asked Toyota to remove the theme, and Toyota graciously bent over and capitulated.

This story raises a much more interesting topic, though: this is the first time a multinational company has publicly acknowledged and embraced the jailbreak community. Considering jailbreaking is technically legal, and Cydia’s creator, Jay Freeman, estimates that up to 9% of OS devices are jailbroken, it simply makes good, commercial sense to target jailbreakers with ads. Toyota was simply trying to make some money, for shame!

As long as Apple continues to throw around its increasingly-expansive mass, the legality of jailbreaking will continue to be inconsequential. It will be interesting to see if another big company dares embrace the jailbreak community after this, too.
